Software Mechanics has and retains copyright in all Materials contained on the Site and in the selection, arrangement and presentation of the Materials (including information in the public domain) and overall design features of the Site.

  • a User may down load to a local hard disk or print extracts (excluding Software) from the Site for personal, non-commercial use only; and

The trade marks, logos and service marks (collectively the ‘Trade Marks’) displayed on the Site to describe companies and their products are the registered and unregistered Trade Marks of Software Mechanics and other third parties. Notice Specific to Software Available on this Site

Any Software and accompanying documentation that is made available for downloading from this Site is the copyrighted work of Software Mechanics and/or its suppliers. Any use of the Software is governed by the terms and conditions of the end User licence agreement, if any, that accompanies or is included with the Software (‘Licence Agreement’). Users will not be able to download or install any Software that is accompanied by or includes a Licence Agreement unless the User agrees to be bound by the terms and conditions of the Licence Agreement. If a User does not agree to be bound by the terms and conditions of the Licence Agreement, the User may not use the Software.

The Software is made available to Users for downloading and use solely in accordance with the terms and conditions of the Licence Agreement. Any reproduction, copying or re-distribution of the Software not in accordance with the terms of the Licence Agreement is expressly prohibited by law. Exclusion

These Terms and Conditions are subject to any terms and conditions that cannot be excluded by law, including without limitation, those implied by the Trade Practises Act 1974 (Commonwealth of Australia). In the event that Software Mechanics is liable for any damages arising out of the use (or inability to use) the Site, liability is limited to the greatest extent permitted by law.

Governing Law and Jurisdiction

These Terms and Conditions will be governed and construed in accordance with the laws of the State of Queensland and the Commonwealth of Australia. The State or Federal Courts located in Queensland will have the exclusive jurisdiction to hear and determine any claims or disputes arising out of or relating to these Terms and Conditions.

Updating or Modification of Terms and Conditions

Software Mechanics may at any time amend, revise or update these Terms and Conditions by posting revised Terms and Conditions on the Site. A Users continued use of the Site constitutes acceptance of these revised Terms and Conditions.
